U.S. House Roll Calls on Unborn Victims
Shown below are the roll call votes conducted by the U.S. House of Representatives on April 26, 2001, on the Unborn Victims of Violence Act. For further information on this legislation, see the story that begins on page 1 of this issue, and extensive information posted on the NRLC website at www.nrlc.org.
The Unborn Victims of Violence Act (H.R. 503), sponsored by Congressman Lindsey Graham (R-SC), is strongly supported by NRLC. The bill would recognize unborn children as victims when they are injured or killed during the commission of certain federal crimes, and would allow prosecutors to bring a second charge for the harm done to the baby.
The bill applies to any "child in utero," defined as "a member of the species homo sapiens, at any stage of development, who is carried in the womb."
The bill would apply when an unborn child is harmed by someone who commits a crime against a pregnant woman that already is covered by any of 68 federal laws listed in the bill. These include, for example, crimes committed on military bases, attacks on federal officials, and terrorist bombings.
The bill explicitly does not apply to legal abortions or to acts by the mother herself that harm her unborn child. Nevertheless, NARAL, Planned Parenthood, and other pro-abortion groups strongly oppose the bill, because they seek to deny any recognition of a right to life for unborn children, even when that right is violated by violent criminals.
The pro-abortion organizations supported an alternative measure, called a "substitute amendment," offered by Congresswoman Zoe Lofgren (D-Ca.). The Lofgren Amendment would have provided stiffer penalties for criminals who cause "an interruption to the normal course of the pregnancy" while committing a federal crime against a pregnant woman, but it would also have enacted the illogical doctrine that such crimes have only one victim - - the mother.
The House first voted on whether to erase the Unborn Victims of Violence Act and replace it with the one-victim Lofgren Substitute Amendment. The Lofgren Substitute failed, 196-229 - - a pro-life victory. This is shown below as Vote No. 1 (official House roll call no. 88). On this roll call, 27 Republicans and 168 Democrats voted to kill the Unborn Victims of Violence Act by adopting the one-victim substitute, while 191 Republicans and 37 Democrats voted to preserve the bill. (One independent member voted on each side.)
The House then passed the Unborn Victims of Violence Act, in its original form, by a vote of 252 to 172 (one member voting " present") - - another pro-life win. This roll call is shown below as Vote No. 2 (official House roll call No. 89).
Final passage of the bill was supported by 198 Republicans and 53 Democrats, and opposed by 21 Republicans and 150 Democrats, with one independent voting on each side.
Of these two roll calls, the first was the most important, because if the Lofgren "one-victim" substitute had been adopted, the Unborn Victims of Violence Act would have died. It is important to note that of the 252 House members who voted to pass the bill, 24 did so only after they had first voted to kill the bill and replace it with the one-victim measure. Those 24 lawmakers' votes appear below as "OX." House members who voted in that fashion clearly demonstrated their preference for not recognizing the unborn child as a crime victim in federal law.
H.R. 503 has now been sent to the Senate, where no action has yet been scheduled. Senator Mike DeWine (R-Ohio) has introduced identical legislation, S. 480.
